A landowner who consents to a development application made by another party is not, by reason of land ownership alone, 'the person in whom the benefit of the application vests' for the purposes of the Ch 4 definition of 'applicant' under the IPA. Vesting of the benefit of a development application requires some transaction or legal mechanism between the original applicant and the person claiming the benefit, determined by reference to the general law rather than the IPA. The development approval under s 3.5.28(1) does not attach to the land until the appeal is finally determined (s 3.5.19), and therefore cannot vest the benefit of the application in the landowner during pending appeal proceedings.
