Where a contract for sale of land contains a specific right of termination for failure to lodge a particular type of application, that right does not extend to failure to lodge other types of applications referred to in the same clause. The express mention of one ground of termination excludes by implication other grounds that might otherwise have been implicit. A real estate agent engaged to sell property may have continuing authority to receive information on behalf of the vendor after execution of a conditional contract, particularly where the agent's commission depends on completion and the information relates to the purchaser's ability to complete. A vendor who continues to treat a contract as on foot despite knowledge of a purchaser's breach of an information obligation may lose the right to terminate on that ground.
