Where an offence of indecent dealing is at the lower end of the scale, the offender was a teenager close in age to the complainant, and there is demonstrated rehabilitation including participation in restorative justice processes, the recording of a conviction may render the sentence manifestly excessive. A sentencing judge who concentrates on particular factors under s 12(2) while undervaluing the totality of circumstances commits an error in the exercise of discretion.
