A sentencing judge must state how a guilty plea has been taken into account as an essential part of the transparency of the sentencing process, pursuant to ss 13(3) and 13(4) of the Penalties and Sentences Act 1992 (Qld). However, failure to do so does not necessarily warrant appellate intervention where the inference from the sentencing remarks is that the plea was in fact taken into account.
