A single application under s 459G of the Corporations Act 2001 (Cth) cannot be used to challenge multiple statutory demands directed to different companies in respect of separate (non-joint) debts; separate applications must be brought for each demand. A verifying affidavit sworn 17 days before the statutory demand, without a supplementary affidavit, renders the demand defective. A written acknowledgement that entry into new contracts does not waive rights under terminated contracts will preserve those rights and defeat a claim of genuine dispute based on alleged compromise.
