Part 16 of the Summary Offences Act 1953 (SA) operates as a self-contained code, and no appeal lies under s 40 or s 42 of the Magistrates Court Act 1991 (SA) against a fortification removal order. The only avenue for challenging such an order on the merits is through the Notice of Objection procedure under s 74BE, followed by appeal under s 74BG. The Kable principle is not attracted because the hearing of a Notice of Objection under s 74BF is a complete rehearing, and the appeal to the Supreme Court under s 74BG involves no departure from accepted judicial standards. A fortification removal order must state the grounds on which it was issued (s 74BC(1)(b)), but there is no requirement to state reasons, and the statement of grounds may be restricted by a non-disclosure order under s 74BB(5).
