A solicitor who has acted for a party in related proceedings and received instructions on matters now in issue will be restrained from acting for the opposing party, even where the opposing party claims to already possess all the relevant confidential information, because the risk extends to misuse (including subconscious misuse) and not merely disclosure. The inherent jurisdiction to protect the administration of justice may be engaged where the solicitor is a potential witness whose conduct may be challenged and who previously acted for the opposite party, even where these circumstances are less clear-cut than in Kallinicos v Hunt.
