The mens rea principles stated in DPP Reference No 1 of 2004; R v Nguyen and R v Van Xuan Bui for drug trafficking and cultivation offences involving commercial quantities apply equally when the Crown seeks to prove commercial quantity by reference to weight rather than number of plants. A case stated must state ultimate facts, must not include evidence, must not contain argumentative passages, and must not seek general advisory opinions on hypothetical facts.
