While a sentencing judge is right to consider the deleterious effects of imprisonment on rehabilitation and to investigate non-custodial options even for serious offences, rehabilitation cannot be elevated above all other sentencing considerations so as to devalue the gravity of the offending. For unprovoked and vicious assaults causing serious injury, particularly where the second offence is committed on bail, the only disposition reasonably open is an immediate custodial sentence.
