An unchallenged finding on causation is fatal to all heads of claim (negligence, breach of contract, and breach of warranty) that depend on the same causal link. A party cannot raise on appeal a wholly different case as to damages involving questions of fact not determined at trial. An order for indemnity costs must be supported by adequate reasons demonstrating the requirements in Hazeldene's Chicken Farm are met; where the judge's reasons do not disclose the reasoning, the order will be set aside and party-party costs substituted.
