When a person who has received a reduced sentence in exchange for an undertaking to give evidence fails to fulfil that undertaking due to threats received in prison, the materialisation of that risk is not a mitigating circumstance on re-sentencing. It simply returns the person to the position they would have been in had the undertaking not been given. The question of where the burden lies in establishing a reasonable excuse for breach of an undertaking was left open.
