Where an affray charge arises from the same conduct as aggravated burglary and intentionally causing injury, the affray may constitute a separate offence involving distinct victims (those placed in fear beyond the assault victim), such that making the affray sentence concurrent does not necessarily result in double punishment. A sentencing judge's reference to an offender's denial of responsibility and characterisation of conduct as 'cowardly' does not necessarily constitute the error of penalising the offender for pleading not guilty, where the remarks go to moral culpability, remorse, and specific deterrence.
