In complex commercial litigation, courts will only seriously entertain pleading objections that significantly impact the proper preparation and presentation of the case at trial. Technical pleading objections that evolved in a different case management environment will not be entertained where modern pre-trial directions (trial bundles, witness statements, expert reports, chronologies, written submissions) adequately define the issues and apprise parties of the case to be met. Particulars need only be provided where necessary to identify the issues and the case to be met, assessed in the context of pre-trial disclosure orders.
