To prove possession of a film classified 'X' under s 81(2)(b) of the Censorship Act 1996 (WA), the prosecution must prove beyond reasonable doubt that the visual images on the seized film are copies of or identical with visual images classified 'X' by the Classification Board. Section 32(1) does not impose any onus on the accused to prove modification. Circumstantial evidence of common titles, classification markings, and OFLC numbers on packaging is insufficient, without more, to establish identity between seized films and classified films beyond reasonable doubt.
