Under s 93(1)(a) of the WCR Act (WA), a worker who has already received workers' compensation and subsequently recovers damages from a third party must repay the employer, even though the statutory language refers to bringing damages 'to account in reduction of entitlement to compensation'. The word 'entitlement' encompasses compensation already received, not merely future entitlements. However, the employer's right of indemnity under s 93(1)(b) is limited to cases where the third party was negligent and does not extend to strict or statutory liability. Statutory compensation under the Civil Aviation (Carriers' Liability) Act constitutes 'damages' for the purposes of s 93(1).
