A liquidator may assign the right to the net balance (if any) under s 553C of the Corporations Act before the balance has been quantified, and the right of appeal is incidental to that assignable property. A bare right of appeal is not itself 'property' under s 9 of the Corporations Act and cannot be assigned in isolation. However, where a judgment debt is assigned, the right to pursue an appeal that would vindicate or increase the value of that debt passes with it as an incidental right.
