The grant of leave to appeal does not advance a bail application because the leave threshold (reasonable prospect of success) is lower than the exceptional reasons requirement; a significantly higher prospect of success must be shown. Where a vulnerable dependant is primarily dependent on the appellant, this is a significant factor that may, in combination with a sufficient prospect of success, constitute exceptional reasons — the greater the dependant's vulnerability, the lower the prospect of success that may suffice in combination. However, unless the appeal is most likely to result in immediate release, continuing incarceration pending appeal involves no injustice regardless of the consequences of incarceration.
