Before confiscation of property following a s 32A drug trafficker declaration can be taken into account in mitigation, the offender must establish that all or a very substantial portion of the property was lawfully acquired — mere 'credible material' suggesting a lawful source is insufficient. Drug purity may be a better indicator of an offender's role in the distribution chain than quantity alone, and where an offender denies connection with the drug, the sentencing judge may rely on the bare facts of quantity and purity to evaluate criminality.
