In a joint trial, where an accused makes serious allegations against prosecution witnesses including police corruption, cross-examination as to the accused's criminal history and character under s 8(1)(e) of the Evidence Act 1906 (WA) is properly permitted. An accomplice warning in a joint trial is adequate where the trial judge's direction carefully separates the evidence of each accused against the other from the evidence each gave in his or her own case, without the need for an express direction that the warning does not apply to the accused's evidence in his own defence.
