External constraints on police resources — including an influx of prisoners and the demands of processing multiple detainees — are relevant to whether the obligation under s 18 of the Bail Act 1978 to determine bail 'as soon as reasonably practicable' has been met. The provision of documents recording spent convictions to a person who already knows their content does not constitute 'disclosure' within s 13 of the Criminal Records Act 1991. A breach of the Privacy and Personal Information Protection Act 1998 cannot ground exclusion of evidence under s 138 of the Evidence Act 1995 because s 6(1) of the Privacy Act prevents it from affecting the exercise of judicial functions, and s 69(1) prevents it from being taken into account in civil causes of action.
