An offsetting claim under s 459H requires particularity, including at least some evidence showing the basis for the claim, justifying its amount and demonstrating bona fides. The narrower the margin between the alleged debt and the claimed offset, the greater the need for particularity. The Court of Appeal will not entertain appeals in statutory demand proceedings that merely reagitate issues already fully dealt with below.
