The Registrar's gatekeeper function under s 327(4) of the WIM Act requires only that the Registrar form a bona fide opinion that a ground of appeal is 'on its face, valid and apparently credible' with a sufficiently realistic prospect of being made out — the Registrar is not required to determine the ground on the balance of probabilities. The pre-conditions in s 327(4) must be satisfied before the Registrar can refer a matter for further medical assessment under s 327(6) and s 329(1)(a). The Registrar is not obliged to give reasons for a decision allowing an appeal to proceed, though it may be different where the Registrar refuses to allow an appeal to proceed. 'Deterioration' under s 327(3)(a) is measured from the degree of impairment certified in the MAC.
