A principal who controls premises and directs where and what is loaded onto a contractor's vehicle does not thereby owe a duty of care to the contractor's employee regarding the manner in which the employee secures the load, where the principal exercises no control over that specific task. The duty under cl 39(a) of the Occupational Health & Safety Regulation 2001 (NSW) to provide safe access to a 'place of work' does not extend to injuries occurring at the place of work itself after safe access has been achieved.
