A council cannot validly delegate to its general manager the power to only approve (but not refuse) a particular development application, as the s 80(1) function to 'determine' an application is indivisible. A direction to exercise a discretionary power in one way only is not a valid delegation. Even where a general delegation exists as an alternative source of power, the delegate must independently consider the mandatory s 79C(1) matters; acting under the council's direction without such independent consideration invalidates the exercise of power. The question whether a later invalid council resolution can impliedly rescind an earlier valid general delegation was left open.
