A road authority's duty of care extends to drivers affected by alcohol; intoxication does not preclude recovery per se but is a matter of degree. Recovery is precluded only where the effect of alcohol has so grossly affected the driver's capacity to control the vehicle that the road authority's negligence makes no material contribution to the injury. The degree of impairment is otherwise reflected in contributory negligence apportionment. However, the dissent's analysis of causation — requiring the accident to be 'of the kind' that might result from the breach, not merely temporally proximate — provides a significant counterpoint where evidence of the plaintiff's actual manoeuvre is sparse.
