For the Christie v Leachinsky exception to the obligation to inform an arrested person of the reasons for arrest to apply, there must be a correlation between the specific offence for which the person is arrested and the person's actual knowledge that they are being arrested for that offence; general awareness that police activity relates to a crime is insufficient. Aggravated damages in false imprisonment require conduct going beyond ordinary human fallibility, and where general compensatory damages are at the upper end of the range, a further increment for aggravated damages may over-compensate. Exemplary damages against police for false imprisonment require more than the mere fact of unlawful arrest; the Court's disapproval of conduct is not itself a sufficient reason for an award.
