An offer of compromise that requires an order for possession and a monetary judgment cannot be treated as more favourable than a result where possession is refused and no monetary judgment is entered, even if the monetary component of the offer was less than an amount the offeree agreed to pay voluntarily. An agreement to pay an amount is both conceptually and juridically different from a judgment in a lesser sum.
