An adjudicator's determination under the Building and Construction Industry Security of Payment Act 1999 (NSW) is void where the adjudicator arrives at the adjudicated amount by a process wholly unrelated to the matters required to be considered under s 22 of the Act. The correct analytical framework for assessing validity is whether essential preconditions for the existence of a valid determination have been met (per Brodyn), not whether there has been jurisdictional error.
