A publisher relying on the s 22 qualified privilege defence must generally lead evidence of the circumstances of publication, its state of mind, and its assessment of the reliability of its sources to discharge the onus of proving reasonableness. The exception in Barbaro, where the published material itself provided strong evidence of the publisher's state of mind, is narrow. The public has an interest in information about how those with the capacity to control newspapers exercise that capacity.
