A transfer of community land by a council in breach of s 45(1) of the Local Government Act 1993, once registered, confers an indefeasible title on the transferee under the Real Property Act 1900. The remedy for a breach of s 45(1) lies in restraining registration before it occurs, not in seeking to unwind the registered title afterwards. Section 138 of the Real Property Act is an ancillary remedy only and cannot be used as a primary mechanism to rectify the Register where a third party seeks to re-vest title in a transferor who opposes it.
