Where the High Court dismisses an appeal from the Court of Appeal, the operative orders are those of the High Court, not the Court of Appeal. An order for a limited new trial is composite in character: final as to issues not remitted (creating res judicata), and interlocutory as to the issues remitted for re-hearing. A party cannot seek to expand the scope of a remitted hearing by applying to the intermediate appellate court, as the operative order is the High Court's and the finality of unreversed findings bars such an application.
