A temporary stay of criminal proceedings conditioned on the prosecution paying the accused's wasted costs requires proof of fault on the part of the prosecution. A fault in the machinery of the administration of justice (such as the failure to detect a disqualified juror) does not, without more, constitute the requisite unfairness. An unfortunate occurrence in the ordinary routine of litigation is not sufficiently extraordinary to justify the exceptional remedy of a temporary stay.
