Where a sentencing judge finds positive rehabilitation prospects for Commonwealth offences, the non-parole period should ordinarily fall within the range of 60%-66⅔% of the head sentence. A sentencing judge who sets a non-parole period above this range without adverting to the ratio or giving reasons for departure will be taken not to have turned their mind to the question, constituting appealable error.
