The person primarily responsible for managing the importation of drugs into Australia is not properly described as having only a 'middle level' of responsibility merely because a more senior person exists overseas. The criminality must be assessed by reference to the offender's involvement in the steps taken to effect the importation, and the existence of a large-scale overseas enterprise is of marginal relevance. For importation of 76.3kg of pure heroin by a senior manager convicted after trial, a non-parole period significantly in excess of 20 years was appropriate (reduced to 18 years 11 months on Crown appeal principles).
