Where a sentence of periodic detention is imposed and cannot be backdated under s 70 of the Crimes (Sentencing Procedure) Act 1999 (NSW), pre-sentence custody and quasi-custody must be accounted for by reducing the non-parole period. The inherent leniency of periodic detention cannot be used to justify extending the term of imprisonment beyond what would otherwise be appropriate.
