The dropping of leaves, flowers, fruit, seeds or small elements of deadwood by urban trees ordinarily will not provide a basis for ordering removal of or intervention with an urban tree under the Trees (Disputes Between Neighbours) Act 2006 (NSW). Residents in urban environments are expected to undertake ordinary maintenance such as gutter cleaning as part of the cost of enjoying the aesthetic and environmental benefits of urban trees. The applicant's age and inability to personally perform maintenance tasks does not alter this principle.
