Conventional estoppel may preclude enforcement of a lease covenant where both lessor and lessee have conducted their relationship on the mutual assumption that the covenant is a 'dead letter', even where the lessor had no knowledge that the lessee might suffer detriment from reliance on that assumption. Promissory estoppel will not be established by mere silence where the defendant did not know the plaintiff might incur detriment. A term will not be implied into a lease to limit the operation of a covenant upon repeal of a related statutory provision where the covenant's validity depended on its independence from that statutory provision.
