An extension of time to appeal will not be granted where the delay reflects a deliberate decision not to pursue a foreshadowed appeal, the respondent has acted to its prejudice on the faith of the judgment, and the proposed appeal lacks merit. Directors who divert company property to themselves by procuring an assignment deed cannot resist an obligation to account merely by asserting that they personally performed the services or made subsequent voluntary contributions, where there is no evidence of a binding obligation to make those contributions in exchange for the assignment.
