A party alleging that a judgment was procured by fraud cannot maintain a collateral action for damages in another jurisdiction while the impugned judgment remains in force. The party must first apply to set aside the judgment in the court that made it. This applies even where the alleged fraud involves fabrication of evidence and collusion between the opposing party and witnesses.
