Late disclosure of forensic evidence by the Crown does not give rise to a miscarriage of justice where the defence was not in fact prejudiced by the late emergence of the evidence and defence counsel made a reasonable forensic judgment not to seek further time or recall of the complainant. A mature adult offender with a history of serious sexual violence convicted after trial of multiple rapes should expect a sentence in the range of 15 to 20 years imprisonment.
