To prove service by post under s 109X of the Corporations Act and s 29 of the Acts Interpretation Act, it is necessary to adduce evidence from a person who can depose to the actual posting of the letter — evidence of office practice alone, without proof that posting actually occurred, is insufficient. A fax transmission report showing the process was 'completed' does not prove that documents were received in complete and legible form and is therefore insufficient to prove service by fax. The question whether originating process may be served by fax (as distinct from other documents) was left open.
