The three-year limitation period in s 588FF(3) of the Corporations Law governs the commencement of proceedings, not the amendment of existing proceedings. Liquidators who have commenced s 588FF proceedings within time may amend those proceedings to add new voidable transaction claims against the same defendant after the three-year period has expired, using the applicable Rules of Court. BP Australia Ltd v Brown does not conflict with this position as it addressed a different issue (shelf applications for extension of time).
