A suspended sentence of six years' imprisonment for three counts of indecent assault by a step-father against his step-daughter (aged 12-14), involving breast touching and touching of the vagina, was upheld on Crown appeal where the offender had no prior convictions, an excellent work record, and family responsibilities. The terms of s 38 of the Criminal Law (Sentencing) Act 1988 (SA) do not require a finding of 'special circumstances' in addition to 'good reason' to suspend a sentence.
