Evidence of flight from the scene of a fatal collision is capable of demonstrating consciousness of guilt of culpable driving causing death, even where the accused initially remained at the scene and identified himself to police, provided that the totality of the evidence (including evidence of derelict driving) supports the inference. The question is whether the accused was betraying a consciousness of being implicated in the actus reus, not whether he had turned his mind to the specific offence charged. The De'Zilwa direction on gross negligence under s 318(2)(b) is sufficient without also reciting the statutory text.
