Mere presence in the vicinity of an affray, even with aggressive and abusive demeanour, does not establish beyond reasonable doubt either direct participation or aiding and abetting where the evidence is equally consistent with the accused being present for an innocent purpose such as seeking police assistance for injuries sustained. Evidence of pre-arrival conduct may be insufficient to cure the deficiency where the jury has rejected related charges based on that conduct.
