Under the Police Regulation Act 1958 (Vic), the right of appeal under s 8AA is validly limited by reg 28(2)(b) of the Police Regulations 2003 to members who applied for the position, unless the Police Appeals Board otherwise determines. The words 'subject to the regulations' in s 8AA(1) authorise regulations that prescribe the circumstances in which the right of appeal may be exercised, including limiting the classes of persons entitled to appeal. A regulation that restricts appeals to applicants subject to discretionary dispensation is a regulation of part of the activity, not a total prohibition.
