On an application to set aside a regularly obtained default judgment, the court is not bound to accept uncritically every assertion in a defendant's affidavit as giving rise to an arguable defence. The court may have regard to whether assertions are equivocal, lacking in precision, inconsistent with undisputed contemporary documents, or inherently improbable. The approach in Eyota Pty Ltd v Hanave Pty Ltd (1994) 12 ACSR 785 is of general application and not confined to statutory demand disputes.
