Where an offender momentarily stops thrusting during sexual intercourse but his penis remains in the complainant's vagina and he then resumes, this constitutes one continuing act of penetration, not two discrete acts. No issue of latent duplicity or uncertainty arises, and the jury need not be unanimous as to the precise point during the penetration at which lack of consent existed, provided they are unanimous that there was absence of consent during the act of penetration prior to its termination.
