The R v Pidoto and O'Dea principle that courts equate ecstasy with heroin for sentencing purposes applies to Commonwealth Customs Act offences, not only to Victorian state drug offences. Hardship arising from a foreign national offender's separation from overseas family does not constitute a basis for reduction of penalty where the offender came to Australia for the sole purpose of committing a serious crime.
