The test for setting aside a default judgment under O 13 r 10 does not require the court to form a provisional view of the probable outcome at trial. Rather, the court must be satisfied that the defendant's case is not inherently incredible and that, if the defendant's evidence were accepted, the defendant would have a real prospect of success. Courts should be very wary of resolving disputed questions of fact on affidavit evidence at the interlocutory stage.
